The Agreement
The short-term holiday rental agreement is between the Guest and the Owner (Mr N MCameron). The contract is deemed to have been made once the Guest has paid a deposit and the Owner has dispatched a confirmation of booking. (It is therefore important that you review them before booking and arriving at the property). The guest must be over 25 years of age at the time of booking. Please note that we reserve the right to amend the Terms and Conditions at any time..
Booking
The Guest who makes the booking is deemed to have agreed to these Terms and Conditions and will be responsible for all persons included in the booking. The Owner reserves the right to decline any booking or refuse to hand over a key to any person who has not complied with these Terms & Conditions.
Number and age of people using the holiday accommodation
The owners permit the Guest and members of the guest’s party (but no one else) to occupy the property for holiday purposes only. Bookings are non-transferable and the property cannot be sub-let. The Guest must declare the correct number of guests during booking and, if this changes, must inform the owner at least 7 days before the rental commences. No more than six people (including children) may occupy the property. You are not permitted to have additional overnight visitors, or rotate guests unless they were listed and paid for during booking, the owner reserves the right to ask you to leave immediately if you are found to be rotating guests or the number of additional guest staying is found to differ from the booking, children must be eight years old or older.
Access
Access The Owner reserves the right to park vehicles, trailers or access the container or sheds in the grounds of Westhaven at anytime, the guests must allow entry to Westhaven or the grounds at all reasonable times for the purposes of inspection, maintenance, or to carry out necessary repairs.
Doggy Policy
Dogs are friends, companions and thought very much as family members, we want you
and your dog to have a lovely break together. However, to ensure that all our guests and
neighbours have an enjoyable time, we must ask that all dog owners observe our Policy
The guest may only bring such pets as are booked in by the guest at the time of booking.
Arrival/Departure
The property (Westhaven) is available for occupation from 5.00 pm on the first day of the holiday and must be vacated by 10.00 am on the last day, it is not flexible. The owner or his agents reserves the right to enter the property at 10am in order to begin the changeover.
Payment
For bookings made more than 8 weeks before arrival, a deposit (part payment) of 50%
of the total cost of the holiday, is required. The balance is due 8 weeks before the holiday
commences. For bookings made less than 6 weeks before arrival, the total amount is
payable in full on booking.
The Guest agrees to pay the balance of the payment EIGHT(8) weeks before the holiday is due to start. Email reminders are sent, but delivery cannot be guaranteed. Where a guest fails to pay their balance by the due date the booking may be cancelled, and the deposit retained.
Cancellation or Changes by the Guest
Once the holiday is booked the Guest has entered into a legally binding contract. If the
Guest cancels, for whatever reason (including medical and weather related) then no
refund of the deposit will be due, and within 8 weeks of the holiday no refund of the full
balance is due. A holiday cancellation protection plan should be taken out to cover forced
cancellations.
Cancellations must be notified in writing (including by email) to the Owner immediately. The Owner will endeavour to re-let the property and if successful may at their discretion allow the guest to transfer to alternate dates for a £20 administration fee plus any other expenses incurred in re-letting. The expenses incurred in re-letting will be at the discretion of the Owner
Once a booking has been accepted by the Owner, Holiday dates may be changed providing the property is available for the new dates and the owner is agreeable to the change. A £20 re-booking charge will be payable.
We recommend and expect that the guest will have or will take out a holiday insurance policy (which includes cancellation insurance covering sickness and unavoidable reasons for cancellation) prior to their stay.
Cancellation by Owners
The owner reserves the right to refuse any booking and to cancel any bookings already
made if the property is unavailable (e.g. through fire, flood, etc) for any reason
whatsoever, subject to a full refund of all monies paid (but no further liability). The owner
will not be under any other liability if such cancellation occurs. Note: in the unlikely
event of a cancellation the owner will make every possible effort to secure alternative
accommodation if required..
Short Term Let Licence

, bookings are conditional on compliance with the licensing scheme, if at any time the application is withdrawn or refused and can’t be resolved, we must stop trading within 28 days, in
that event guests with affected bookings will receive a full refund.
Guest Responsibility
The supervision of children, dogs and any adults requiring care remains the responsibility of the guest.
Guests should put all furniture etc. back to where it was at the beginning of the rental period.
Guests should not leave any items at the property and, if left, the owner has the right to charge for the removal, return or disposal of those items.
Camper Vans/ Motor Homes
Camper Vans/Motor Homes must not be parked in the grounds of Westhaven, unless with the prior written approval from the owner, under no circumstances are tents allowed to be pitched in the garden.
Charges
Sheets, duvet covers, pillowcases, towels, tea towels, hand towels and bathmats are included in the rental. Please bring your own beach towels and dog towel.
Cleaning
We would like to think the holidaymaker and party would treat the property as they would
their own home and at the end of the holiday the property is left in a clean and tidy
condition. The property owner retains the right to make an additional charge for cleaning
should the property not be left in a similar condition to the way it was found at the start of
the holiday.
Breakages,Damage, Loss, Theft
Guests should make every effort to keep the property, fixtures and fittings and all
contents in the same state of repair and condition as at the start of the holiday. Any
accidental damage or breakages should be reported to the property owner prior to
departure. The property owner retains the right to make an additional charge for damage
and breakages although it should be noted that minor breakages and reasonable wear
and tear (in the opinion of the property owner) will not be charged for if reported. Guests should not
remove any item from the property. The owner may ask for reasonable replacement costs.
Please do not replace any items yourself..
Smoking/Vaping
Westhaven is stickily no smoking or Vaping throughout, The property owner retains the right to ask the guests to leave immediately and make an additional charge for cleaning should there be any evidence/smell of someone smoking or vaping.
Electric Vehicle Charging
Guests are not permitted under any circumstances to charge any sort of electric vehicles at Westhaven.
Sleeping Arrangements
Guests are not permitted to use any rooms other than the bedrooms as sleeping accomodation.
Nuisance
If, in the opinion of the owner, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties or the surrounding area, vicinity, the contract may be treated by the owner as discharged and the property repossessed immediately. The guest will remain liable for the whole cost of rental and no refund shall be due.
Wildlife
The property is in a beautiful rural area. Please therefore expect to meet some wildlife, including the odd spider, mouse, bird, fly, bee, wasp or other creature, which may make their way into a property unbeknownst to the owner. Contact the owner only if the creatures become a serious menace. Otherwise, open a window or a door and let them out. The owners reserve the right to take no action if they do not consider the existence of the wild life to be a serious threat to health.
Breakages/Cleaning Deposit
The owner reserves the right to charge the Guest a breakages/cleaning deposit.
Liability
The owner cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather.
No responsibility is accepted for loss or damage of property, (including pets), vehicles or vehicle contents belonging to the guest or any member of the party during their occupancy.
The maximum liability accepted by the owner will be the total cost of the holiday as paid by the guest. No other expenses such as travelling costs or alternative accommodation will be accepted.
Force Majeure
The agent or owner cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.
Waiver
The failure of the owner to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.
Miscellaneous
The guest agrees that the contract with the owner is made at the owner's premises and that any proceedings between the parties shall be conducted in the County Court nearest to the owner.
Complaints
In the, hopefully, unlikely event of there being a problem or you have a complaint, it is essential that you advise the owner immediately, during your stay, so that they can investigate and take any necessary remedial action to rectify matters during your holiday. Retrospective consideration will not be possible.
